General conditions
The following general conditions expressly regulate the relationship between Profesional Cosmetics S.A., the CIF A08739906 and the third parties which is a donation to the users and / or to the purchase of products through the online bulletin of the official web site of Profesional Cosmetics S.A. 1. Obligations of the user
The user agrees, in general, to use the store, to purchase the products and to use each of the services of the store diligently, in accordance with the law, morality, public order and the provisions of these general conditions, and must also refrain from using them in any way that may prevent, damage or impair the normal operation and enjoyment of the store by users or that could damage or cause damage to the property and rights of Profesional Cosmetics S.A., its suppliers, users or in general any third party.
2. Products and prices
2.1 Profesional Cosmetics S.A. reserves the right to decide, from time to time, the Products offered to users through the store. In particular, Profesional Cosmetics S.A. may at any time add new products to those offered or included in the store, it being understood that unless otherwise provided, such new products shall be governed by the provisions of these general conditions.
Also, Profesional Cosmetics S.A. reserves the right to stop providing or facilitating access and use at any time and without notice of any of the different types of products offered in the store.
2.2 The Products included in the Store shall correspond as closely as possible to the products actually offered.
The characteristics of the Products and their prices appear in the Shop. The prices indicated in the Shop are in Euros and include VAT, unless otherwise indicated.
3. Procedure and method of payment of the products
3.1 Within twenty-four (24) hours, Profesional Cosmetics S.A. will send an email to the user with the purchase confirmation. This email will assign a reference code of the purchase, and will detail the characteristics of the product, its price, shipping costs and data of the various options for payment of the products to Profesional Cosmetics S.A..
3.2 The user who purchases a product through the store must make the payment using the payment systems specifically detailed in the store.
3.3 Profesional Cosmetics S.A. will file the electronic documents in which the contract is formalized, sending a copy to the user once the purchase is made. The contract shall be made in the Spanish language.
3.4 The order confirmation sent by Profesional Cosmetics S.A. is not valid as an invoice, only as proof of purchase. Profesional Cosmetics S.A. will send with the product the corresponding invoice.
4. Right of withdrawal
4.1 The user has a right of withdrawal by which you may contact Profesional Cosmetics S.A. via email info@hairgrant.com and withdraw from the purchase within a period not exceeding seven (7) working days from receipt of the product.
The Product must be sent together with the delivery note or invoice, duly completed, at the customer's expense the direct cost of returning the product. Such return shall be made in accordance with the instructions that Profesional Cosmetics S.A. indicates to the user in response to its notification of the exercise of withdrawal. The user must return the product within a maximum period of seven (7) days after Profesional Cosmetics S.A. indicates the method of return.
4.2 The withdrawal entails the refund of the amount paid except the cost of returning the product. To do this, the customer must indicate on the return form the number and holder of the credit card to which Profesional Cosmetics S.A. shall make the payment. The deadline for such payment shall be as provided by law.
4.3 The right of withdrawal may not be exercised when the product is not returned in its original packaging and when the product is not in perfect condition.
5. Customer service
5.1 For any incident, claim or exercise of their rights, the user may send an email to the address info@hairgrant.com.
6. Home delivery service
6.1 The territorial scope of sales through the store is exclusively for the territory of the Iberian Peninsula, so the delivery service will only be for that territory. The products purchased through the store will be sent to the delivery address indicated by the user once the payment has been verified, being the maximum delivery time of thirty (30) days established by default in the Law.
6.2 The delivery service of Profesional Cosmetics S.A., is carried out in collaboration with various logistics operators of recognized prestige. Orders will not be served in PO Boxes or hotels or other non-permanent addresses.
6.3 The cost of shipping is not included in the price of the products. At the time of purchase of the product, the user will be informed of the exact cost of shipping.
7. Intellectual and industrial property
7.1 The user acknowledges that all elements of the store and each of the products, information and materials contained therein, trademarks, structure, selection, arrangement and presentation of its contents, and computer programs used in connection therewith, are protected by intellectual and industrial property rights of Profesional Cosmetics S.A. itself or third parties, and that the General Conditions do not confer on such intellectual and industrial property rights any rights other than those specifically provided for therein.
7.2 Unless authorized by Profesional Cosmetics S.A. or, where appropriate, by third parties holding the corresponding rights, or unless legally permitted, the user may not reproduce, transform, modify, disassemble, reverse engineer, distribute, rent, lend, make available, or allow access to the public through any form of public communication of any of the elements referred to in the preceding paragraph. The user shall use the materials, elements and information accessed through the use of the store only for their own needs, agreeing not to make any direct or indirect commercial exploitation of the materials, elements and information obtained through the same.
7.3 The user shall refrain from circumventing or manipulating any of the technical devices established by Profesional Cosmetics S.A. or third parties in the store.
8. Data Protection
8.1 In compliance with Law 15/99 LOPD, we inform you that your personal data and other information provided through the registration form, as well as from transactions made, will be included and retained in a file for processing, owned by Profesional Cosmetics S.A., until cancellation is requested.
The treatment will be used for the development and execution of the sale, the personalized attention of the products and services you purchase and the improvement of such attention, as well as the promotion of products and services.
It also informs you that in no case your data will be made available to third parties.
The user expressly authorizes Profesional Cosmetics S.A. the remission, including through electronic means by Profesional Cosmetics S.A. commercial communications and promotional offers and contests.
8.2 The user may at any time exercise their rights of access, rectification, opposition or cancellation by contacting Profesional Cosmetics S.A., Química 5, 08740 Sant Andreu de la Barca, Barcelona, Spain, or by e-mail to info@hairgrant.com, enclosing a copy of their N.I.F. or substitute identification document.
8.3 The answers marked with * in the registration form are mandatory. Failure to answer them will prevent the purchase of the selected products.
9. Passwords
Profesional Cosmetics S.A. will provide the use of personal passwords to the user who registers as such on the website. These passwords will be used to access the services provided through the Website. The user must keep the passwords under his sole responsibility in the strictest and absolute confidentiality, assuming, therefore, any damages or consequences of any kind arising from the breach or disclosure of the secret. For security reasons, the password for telematic access to the services linked to the Website may be modified at any time by the user. The user agrees to notify Profesional Cosmetics S.A. immediately of any unauthorized use of your password, as well as access by unauthorized third parties to it.
10. Cookies
10.1 Profesional Cosmetics S.A. uses cookies in order to improve its services, facilitate navigation, maintain security, verify the identity of the user, facilitate access to personal preferences and track your use of the store. Cookies are files installed on the hard disk of the computer or in the memory of the browser in the folder preconfigured by the operating system of the user's computer to identify the user.
10.2 If the user does not want a cookie to be installed on his hard drive, he must configure his Internet browser not to receive them. Likewise, the user may freely destroy cookies. If the user decides to disable cookies, the quality and speed of service may decrease and even lose access to some of the services offered in the store.
11. Applicable Law and Jurisdiction
These general conditions are governed by Spanish law. Any dispute arising from the interpretation or execution that may arise in relation to the validity, interpretation, performance or termination of this contract shall be subject to the Jurisdiction and Jurisdiction of the Courts and Tribunals of the City of Barcelona, waiving the jurisdiction that may correspond to the user, provided that the applicable law so permits.
